NUPE found itself in a contrawner were announced (on Monday April 16) involving injunctions brought against three local authorities on behalf of school meals staff.

In Birmingham the court upheld NUPE's claim that the Council education committee had exceeded its powers in breaking national agreements and dismissing about 5,000 school meals staff in order then to offer reengagement on worse terms and rates of pay. However, Hertfordshire and East Sussex councils, employing about 4,100_ and 1,400 school meals , workers respectively, were judged to have acted properly in making their dismissal decisions which had been forced on them by the government's spending limits.

A consequence of the rulings is that it gives the green light for councils throughout the country to take similar steps to cut the costs of their school meals services by reducing the pay and conditions of their employees, regardless of national agreements.
